






RESOLUTION OF THE BOARD OF SUPERVISORS OF THE
COUNTY OF SANTA BARBARA, STATE OF CALIFORNIA
RESOLUTION MAKING DETERMINATIONS,
AND ORDERING INCORPORATION
SUBJECT TO CONFIRMATION BY THE
VOTERS, OF A CITY OF GOLETA; CALLING
RELATED ELECTIONS; AND ORDERING
CONSOLIDATION OF THE ELECTIONS
BE IT AND IT IS HEREBY RESOLVED that the Board of Supervisors of the
County of Santa Barbara ("Board") does determine and order as follows:
Preliminary proceedings for incorporation of a new city were initiated by
a petition signed by more than 25 percent of the registered voters in the
area proposed to be incorporated.
Thereafter, the Santa Barbara Local Agency Formation Commission
("LAFCO") conducted appropriate proceedings which on May 3, 2001
culminated in LAFCO's Resolution 99-20 making determinations
approving the proposed incorporation and authorizing the Board to

at 9:00 a.m. or as soon thereafter as the matter could be heard, in the Board

No majority protest pursuant to California Government Code sections
57077 and 57078 was made. Those sections therefore require the Board to
order the proposed incorporation subject to confirmation by the voters.
Rincon Consultants, Inc., an independent environmental consultant,
conducted an environmental review of the proposed incorporation and
prepared a negative declaration which LAFCO adopted. The action of the
Board in submitting the incorporation proposal ("proposal") to the voters
is ministerial and not a project as defined by the California Environmental
Quality Act, California Government Code section 15378.

The reasons for the incorporation as set forth in the proposal are to
increase local control and accountability for decisions affecting the
community through a locally elected city council, retain local tax
revenues for use in the community to support municipal programs
and services, promote cost-effective services tailored to the needs of
local residents and landowners, increase opportunities for
participation in civic and governmental activities and promote
orderly governmental boundaries.

attached and incorporated as Exhibit A and can be described as the
western Goleta Valley bordered by the urban growth line of the
Goleta Community Plan on the north; the western edge of the
Bacara Resort on the west; the Pacific Ocean, Santa Barbara Airport
and the University of California property on the south; Maria
Ygnacio Creek on the east, south of Highway 101; and parcels east
of Kellogg Avenue and Cambridge Drive, including those located
south of Coralino Road and west of San Jose Creek north of

Pursuant to California Government Code section 57176 and Article
13B of the Constitution of the State of California, the vote required
to confirm the order of incorporation is a majority favorable vote
within the entire territory in which the election is ordered held.
At the same election the voters of the proposed city shall elect five
members to the Goleta City Council. The terms of office of the City
Council members shall be four years. Of the first elected legislative
body, the terms of the three City Counsel members receiving the
most popular votes shall be four years from the date of
incorporation and the terms of the two candidates receiving the
least popular vote shall be two years.
At the same election the question shall be presented as to whether
members of the City Council in future elections are to be elected by
district or at large. The question to be submitted to the voters is:

The Board hereby consolidates the special election called by this
resolution with all other elections which will be conducted by the Santa
Barbara County Clerk-Recorder on the same date and in the same
territory. The County Clerk-Recorder is directed to give notice of the
special election as required by law. He shall also establish precincts and
polling places for the elections, shall canvass the returns of elections and
certify the results thereof to the Board.
