Randy Olson Fraud Story

The recent political attacks on Jim Hoffa, Chuck Mack and poor Marty
Frates, are the work of TDU, Randy Olson, his rigt-hand man, Craig
Gonsalves, and Chuck Engle. These guys masquerade as Teamsters. In
reality, they are nothing more than a cheap, political hit squad.

1. They post NLRB charges - NLRB 32-CB5002. What they fail to post is
the decision. CASE DISMISSED. 2. They post Election Officer Charges,
PR-295 and, again they fail to post the decision. Once more, CASE
DISMISSED. 3. The law suit ---- again one side of the story. When the facts
come out it will be the same result. Case Dismissed. 4. The Randy Olson
discharge. He blames everyone but himself. Fact: He did not have the guts
to show up for his own grievance. We're not surprised. He did not show up
on the UPS picket line in 1997 either. NO EXCUSE. Now he's suing Local
70 and he is asking you to donate money to support his suit. TALK ABOUT
FRAUD!

When I asked all those mud slingin' Monday morning quaterbacks...so
called friends of Randy Olson why they didn't show up to support Randy at
the hearing I never got an anwer. I bet I know the reason now .....just
maybe it had something to do with Randy not showing up to his own
hearing. They claim it was an open and shut slam dunk case. That is their
claim, not mine, but one of the best ways I know to show a grievance panel
that you don't care much about your job is to not show up. Then the
company can make up any damn lie they want and bury you. Of course, if
he didn't show up it may be that he knew they were going to bury him with
the truth.

Does the funds being raised for Randy go to him or to TDU/TRF/Ken Paff
in Detroit by the way.

I'm glad to see that you gentlemen are exercising your right of free speech.

I would like to make a few clarifications to your post.

1. Poor Marty Frates? Business Agent Marty Frates was just appointed to
the UPS National Grievance Panel by Teamster President James P. Hoffa.
This puts Mr. Frates in the category of only a few esteemed individuals who
are the leading experts in the UPS grievance Process in the United States.

2. The three gentlemen that you named are members of TDU. All three
were supporters of Tom Leadham and Mr. Olson was Chuck Mack's
opponent in the 1995 Secretary-Treasure election at Teamsters Local 70 in
Oakland, Ca. Yes, politics are involved and in fact the cause of Mr. Olson's
firing from UPS.

3. The NLRB charges were withdrawn by Mr. Olson in favor of filing in
Federal Court. NLRB charges must be withdrawn if one chooses to file in
the courts. Can't do both.

4. The complaint with the Election Officer was dismissed. Mr. Olson was
advised that these charges fell outside of the limited jurisdiction of the
Teamster Election Officer. It was stated that remedy must be sought
through the NLRB or Federal Court.

5. You stated, " He did not have the guts to show up for his own grievance".
You must take into consideration that Mr. Olson was ill and in the hospital.
Mr. Olson's doctor issued an excuse which was faxed to Mr. Frates and the
Grievance Panel. The panel chose to violate the Grievance Panel By-Laws
and continued the hearing illegally.

You will find that the answers to most questions you may have are clearly
stated in the Complaint to the Federal Court. Read the complaint for greater
detail (click below).

Dear Grievance Panel Randy has an owie,(ouch, ouch) a really, really big
owie (ouch, ouch, ouch) and can not come out to play today. He got his
owie (ouch, ouch) running his non-union crews for one of his business
ventures. These stressful non-union (scab) ventures take up all of his time
and are very stressful and so Randy can't play at UPS either. Well, I have
to go and make me some green eggs and ham.

Yes, you sound like a member of the Management Team of the notorious
West Coast Corporate Labor Vender Teamsters Local 70. The child like
mannerisms are the giveaway. You sound just like Mr. Frates or perhaps a
student of his. Perhaps you should have started your post with "na, na na
na, na. na, na, na".

You have treated the readers of Teamster.net to the depths of Local 70's
defense in the Olson case.

I don't think a jury is going to buy the " na, na na na, na. na, na, na "
defense nor are the enlightened readers of teamster.net. But it is your right
to try it. Have you considered a plea of insanity? That might work.

I don't know, Randy. If it was my job on the line I would crawl to the hearing
if I could. Can you please tell me the nature of your medical condition?

Dear Bill,

I do not have knowledge of Mr. Olson's medical condition but according to
his doctor, at San Leandro Hospital he would not be able to drive the 300+
miles to Reno that morning for a grievance hearing.

I can tell you that Mr. Olson's faxed excuse was received by the panel,
discussed and ignored.

Dear Panel, We can't be there to support our friend Randy at the hearing.
We all have owies too(ouch, ouch). We all called out of service too to work
with Randy that day on a non-union job he was contracting. We can't be
there for our friend Randy but you can see our pictures in the Convoy
proudly saying we will be there at the next TDU convention. We also are
proud to show our faces in our neighborhood to underbid the union
contractors so we can earn our way to the convention...what a big party we
will have when we get there. We are also here now to ask for your money.
We didn't donate our time or money for Randy but we sure can ask you to
donate yours. If you hurry up and donate we are offering a special limited
time promotional sale item extra...the Brooklyn bridge.

My Dear Dr. Seuss,

I thought at first you might be Business Agent Marty Frates but I have
changed my mind. Your posts are just too stupid. Marty knows the facts of
this case and I don't think that he would have to use vaguely
comprehensible irrelevant babble for his defense. Marty is an expert in the
legalities of the UPS grievance process. Marty's defense would be
significantly more astute and relevant.

Give it up. You are not a good heckler!

I'm sure glad your on Marty's side and not on ours. Please stay there!

Randy Olson Deserves support. He has been fighting for reform for years.
He got in an unfortunate car accident, this could happen to anyone, and
was out of work. Before the three year limit was up UPS illegally removed
him from the seniority list. Then Local 70 dropped the ball on his grievance.
Randy will have his day in Fedreral court. And Mack will pay.

No wonder the panel ignored the doctor's excuse- it does not even say
what was wrong with him!

Dear Mr. Higgins,

Medical information is confidential. Your medical records, my records and
Mr. Olson's records are all protected by law. If the court deems them
relevant they can be subpoenaed by attorneys representing UPS or
Teamsters Local 70. Until then medical information is out of bounds and the
panel is not entitled to that information.

They were entitled to verify with San Leandro Hospital to confirm that the
doctors excuse was in fact genuine. They chose not to and ignored it. They
proceeded illegally.
